limited liability company (hereinafter referred to as "MMI," “us” or "we") and we are committed to maintaining
strong and meaningful privacy protections.
The privacy of your information is a significant responsibility and we

information we collect, how we use it and your options regarding certain uses

applications and tools MMI offers (collectively, the “Services”) and any other

WHAT TYPES OF INFORMATION MMI COLLECTS
MMI gathers information from you in
two ways: (1) information you provide voluntarily, including, without
limitation, during voluntary registration or related to Equipment listings, and
(2) information passively collected through technologies, such as cookies, web
beacons and server log files.
Information You Provide. The “personal information” we collect
includes information you provide us, which may consist of name, postal address,
telephone number, email address, date of birth, demographics, activities,
location information and payment information and other reasonably identifying
information relevant to customer surveys, and/or offers. Personal information does not include
“de-identified,” “anonymous” or “aggregate information,” which are not
associated with a specific person or entity. You may give us personal information in a
variety of ways, including, without limitation, when you:
(A) Purchase or use any Services or engage in other online transactions on the Site;
(B) Sign up for our membership or otherwise receive our publications, email communications, and feeds from blogs and social media, link to our social media platforms, and use our application (e.g., addresses for email and other electronic communications, log-in information, social media account information).
(C) Communicate with us through our Contact Us page (please note that you should not send confidential or proprietary information to us via email, other electronic communication, or via a post to a public platform); or

Download content from the Site and when you otherwise knowingly
provide personal information to us.
Information Collected Automatically. We automatically collect information
about you or the browser or device you used to access the Site or to transmit
information (such as hardware model, operating system version, unique device identifiers,
and mobile network information including phone number), log information
(Internet Protocol address, browser type, system activity, hardware settings,
browser settings and language, date and time of access, last URL visited,
cookies, how you used the Site), cookies that may uniquely identify your
browser, and, if you enable Site features that are enabled for location
detection, we may collect information about your actual location (such as GPS
signals and other geo-location data), when you access the Site, using automated
means such as cookies, web server logs, web beacons and JavaScript. We may link information we automatically
collect with personal information for any lawful purpose, such as to improve
and analyze the use of our Services, to improve the visitor experience at the
Site or our membership, to deliver services or products, to communicate with
you, to monitor the security and integrity of the Site and to analyze our
operations. We may also send a “cookie,” “pixel tag,” clear gif or web beacons
to your device that contains identification unique to the device you are using.
The information we receive through cookies, web beacons and similar
technologies may enable us to recognize users across devices, such as
smartphones, computers, tablets or related browsers. Depending upon your device
or computer, you may be able to set your browser(s) to reject cookies or delete
cookies, but that may result in the loss of some functionality on the Site.
HOW MMI USES YOUR INFORMATION
Our primary purpose in obtaining your
information is to provide you with the Services as efficiently as possible and
communicate with you in various ways. For example, MMI uses your personal
information to identify you as a customer, to set up and administer your account,
to take, process, and deliver your bids for equipment, to process or obtain
payment of your orders, and to provide you with effective customer service
and/or technical support. More specifically, we may use the information you
provide directly to us and information collected by automated means for a
number of purposes, including to:
(A) Process, evaluate, and respond to your purchases, requests, inquiries, and applications;
(B) Create, administer, and communicate with you about your accounts, including by email;
(C) Contact you with marketing communications online and offline (including co-marketed and co-branded communications), and compile aggregated statistics and determine the effectiveness of our promotional campaigns;
(D) Display relevant advertising to you on the Site and across the Internet for MMI, our co-marketing or co-branding partners or other third parties (such as third parties that wish to display ads or other content on our Sites);
(E) Verify your identity and track how you use our Site;
(F) Operate, evaluate, and improve our business (including developing new products and services; manage our communications;
(G) Perform market research and data analytics and data enhancement; determine and manage the effectiveness of our advertising and marketing; analyze, improve and customize products, services, the Site and communications; administer the Site;

WHEN WE SHARE YOUR INFORMATION
Sharing With Affiliates, Successors
and Assignees. We may share any of the information we
collect with affiliated companies under common ownership or control, such as
companies that are part of the MMI family of companies, and any successors and
assignees of MMI. We share information with our affiliates so that they may
provide you with information regarding products and services that may be of use
to you, and for any other use set forth in this Privacy Statement. If we choose
to share information we collect in this fashion, we will require our affiliates
to honor this Privacy Statement.
Sharing With Nonaffiliated Third
Parties. We may share any of the information we collect with any
nonaffiliated third parties, such as dealers, original equipment manufacturers
or potential buyers or sellers, with whom we offer co-branded, joint, or
customized products or services, or other parties whose offers of services or
products we believe you may wish to receive. This information may include, for
instance, your contact information and information about your purchases or
likely interests. Third parties may use non-personal information in order to
display advertising that reflects the interests and preferences of our user
community.
Sharing With Service Providers. We share personal information we
collect on the Site with our service providers. These may include, for
instance, third parties that provide services to us regarding email marketing,
market research, data analytics and data enhancement, customer service, site
operations and hosting, systems management, accounting, auditing, billing,
reconciliation and collection activities.
Sharing of Aggregated or Anonymized
Data. We may share
aggregated, anonymized or de-identified personal information with any third
party, without any restriction, including through the use of cookies and other
automated technologies. We may share personal information at your request.
Sharing As Required by Law and at Our
Discretion. Subject to applicable law, we may
disclose information about you: (A) if we are required to do so by law, regulation
or legal process, such as a subpoena; (B) when we believe disclosure would be
appropriate in response to requests by government entities, such as law
enforcement authorities; (C) when we believe disclosure is necessary or
appropriate to prevent physical, financial or other harm, injury or loss to
ourselves or any person (including regarding any potential violation of the law
or our terms or policies); (D) in connection with an investigation of suspected
or actual unlawful activity; or (E) for fraud detection and prevention.
Sharing Upon Corporate Events or
Changes. We also will transfer personal
information we have about you in the event we sell or transfer all or a portion
of our business or assets (such as in connection with a merger, acquisition,
reorganization, dissolution or liquidation) or take steps in anticipation of
such a transaction.
Third Party and Social Media Plug-Ins. Third parties may collect information
about your online activities over time and across different websites when you
use the Site. For example, we may enable social network plug-ins, whereby those
social media providers embed content and tools on our Sites (i.e., the
plug-ins), which may collect personal information directly from you in
connection with your interaction with such content and tools. Such providers'
use of the information is subject to their own privacy policies, which we
recommend you review. We are not responsible for such providers' privacy
practices, which are not covered by this Privacy Statement.
HOW WE PROTECT YOUR INFORMATION
We use a
variety of physical, electronic and procedural safeguards to protect your
personal information from loss, misuse and unauthorized access, disclosure,
alteration and destruction while it is under our control. Employees are trained
on the importance of protecting privacy and on the proper access to, use and
disclosure of personal information.
Under our practices and policies, access to sensitive personally
identifiable information is authorized only for those who have a business need
for such access.
Although we
work hard to protect personal information that we collect and store, no data security
measures are 100% secure and we cannot guarantee that our safeguards will
prevent every unauthorized attempt to access, use or disclose personal
information. MMI maintains security and incident response plans to handle
incidents involving unauthorized access to private information we collect or
store.

Statement. We will work with you to
address any problems.
We retain
information only as long as reasonably necessary for business, accounting, tax
or legal purposes. When we dispose of
personal information, we use reasonable procedures designed to erase or render
it unreadable (for example, shredding documents and wiping electronic media).
YOUR CONTROL OVER PERSONAL INFORMATION
We strive to keep our customer
records as accurate as possible.
If you have provided personal
information to us and wish to revoke our use of it, you will need to send us a
written request (first class mail, email, or other reliable form of written
communication) to delete or cease use of your personal information. We are not
required to alter or delete information stored for purposes of backup or
disaster recovery. In addition, you should be aware that may not
technologically possible to remove each and every record of information you
have provided to use from our servers.
You play an important role in
ensuring the security your personal information. We encourage you to use safeguards
to protect your information. Please remember that you are solely responsible
for maintaining the secrecy of any password you use to register and you should
always be careful and responsible whenever disclosing information online.
You should be aware that if you
voluntarily disclose personal information online in a public area, that
information may be collected and used by others. We do not control the actions
of our visitors and registered users. If you disclose personal information in a
publicly accessible place in the Site, you do so at your own risk and you
understand that your submitted information may be collected and used by others
to send you unsolicited messages, advertisements, or for other purposes. The
foregoing does not waive MMI’s right to enforce any legal and contractual
rights it may have against those who scrape, crawl or extract data from the
Site, including any such restrictions that may be set forth in our other posted
terms and policies.
If you register with the Site, from
time to time, we may email you with informative messages about our services or
third party products and services we believe may be of interest to you. If you
do not want to receive these types of emails please let MMI know by email to info@mmi-direct.com.
MMI may also provide opt-out information in its marketing communications
via an "unsubscribe" link in communication emails, which would unsubscribe
you from any further communications from us that are unrelated to a service we
are providing or are required to provide to you. Please note that it may take
us some time to process your requests, consistent with applicable law. Note
that you do not have the ability to opt-out of non-marketing communications
that we send you in connection with the use of our Services, such as when you
have engaged in transactions with us.
PAYMENT INFORMATION
Your credit card, wire transfer or other payment information
may be transmitted to a third party processor.
INFORMATION ABOUT CHILDREN
We are committed to protecting the privacy of
children. The Site is not designed or intended to attract or target children
under the age of 13. The Site does not collect personal information from any
person whom we actually know is under the age of 13. If you are under the age of 18, you may use
the Site only with permission of a parent or guardian.
CALIFORNIA PRIVACY RIGHTS
California Civil Code Section 1798 entitles California
customers to request information concerning whether a business has disclosed
personal information to any third parties for the third parties’ direct
marketing purposes. As stated in this Policy Statement, we will not sell or
share your personal information with non-affiliated companies for their direct
marketing purposes without your consent. California customers who wish to
